The process involves placing temporary paint markings or flags on the property, and this is something the agent needs to prepare their seller for. Agent responsibility: Before booking an install, please inform your seller that utility locating flags or spray paint markings will be placed on or near the property. These are temporary, placed by the utility companies, and required by law. Sellers should not remove them before we arrive. The 811 process typically takes 2-3 business days from the time we file. We cannot install a sign until clearance is confirmed - this timeline is set by the utility companies, not by us. We'll keep you updated as the clearance comes through. How the 811 Process Works Agent books the install via our online portal or text. Provide the full property address. We file the 811 request the same day we receive your booking. Agent notifies the seller. Let your seller know that utility locating crews may come by and place flags or paint markings on the property within the next 1-3 days. These are temporary and required - sellers should leave them in place until after our install. Utility companies locate and mark underground lines. Each utility (gas, electric, water, telecom) has up to 2 business days to respond. Markings appear as spray paint or small flags on the ground near buried lines. Clearance confirmed - we schedule the install. Once all utilities have responded, we schedule and complete the install. You'll receive a photo confirmation the moment it's done. Markings fade or disappear on their own. Utility paint markings are temporary and water-soluble. Important: If flags or markings are removed by the seller before our install, we will need to re-file the 811 request. You are responsible for the costs of relocating the install: a $25 hole change fee for our crew to drill a new hole at an alternate location, plus a $20 811 re-filing fee if we need to re-file for clearance from a different spot. Why this policy exists: By placing your own flags and paint, you're taking on the responsibility of ensuring the site is clear of known hazards. If an unmarked private utility is struck, it can result in property damage, service outages, and serious liability. These fees help cover the cost of our crew's time to relocate the install and our re-filing with 811. We appreciate you taking on the discount - just understand the liability that comes with it. 2. Installation Process How we install - and what to expect at the property Once 811 clearance is confirmed, our crew schedules the install and arrives at the property. Here's exactly what happens and what we use. Method: Spade Shovel & Packed Dirt We install all sign posts using a spade shovel - a manual, hand-driven method that gives us precise control over placement and depth. We do not use mechanical post drivers or heavy equipment. The post is set into the ground and the surrounding dirt is packed firmly by hand to ensure the post stands straight and secure. This method leaves a minimal ground footprint, avoids turf damage, and keeps the install clean - no mess, no machine marks, no tire ruts in the lawn. Why manual? A hand-dug, packed-dirt install is safer near utility lines confirmed by 811, gentler on lawns and landscaping, and produces a cleaner, more professional result than mechanical drivers. The post is just as secure. What to Expect During an Install Crew arrives at the property. No need for the agent or seller to be present. We work independently and handle everything ourselves. We review the 811 markings on site. Our crew checks the utility markings before digging to confirm the chosen post location is clear of all underground lines. Post hole is dug with a spade shovel. We dig to the appropriate depth for the post size, keeping the hole clean and contained. Post is set and dirt is packed. The post is placed, leveled, and the removed dirt is packed back in firmly around the base. No concrete or filler is used - packed native soil is sufficient and makes future removal clean and easy. Sign panel and any riders are attached. The sign panel, and any requested riders (open house, price reduced, etc.) are mounted to the post. LEDs installed. LED lighting added to the sign during this visit at no additional charge. You may opt out if you do not want LEDs on the sign. Photo confirmation sent. We photograph the finished install and send it to you immediately via our online portal and text. The install is complete. Placement Guidelines Post placement is at our crew's discretion based on utility clearances, property layout, and street visibility. We aim to place signs in the most visible, compliant location possible. If you have a specific placement preference, include a note when booking and we'll do our best to accommodate it, though safety and compliance always take priority. We do not install signs on city-owned sidewalk strips, medians, or public right-of-way. Signs must be placed on the seller's private property. With some exceptions, text or email us for specific restrictions around your listing. 3. Removal Removal is included in the Install + Remove Package. When you're ready, book the removal through our online portal or text us. Our crew pulls the post cleanly, packs the small remaining hole, and leaves the lawn tidy. A photo confirmation is sent immediately on completion. Extended listing policy: If your sign remains in the ground beyond 3 months from the install date, a $25 per 6-month period applies to keep your sign maintained. We track the timeline on our end - no action is needed from you unless you want to schedule removal. 4. Theft & Damage Replacement What happens if a sign is stolen or vandalized - and what it costs to replace Real estate signs and their components are occasionally stolen or vandalized. While we take reasonable care of all installations, we are not responsible for theft or intentional damage after the sign is installed. Cancellation & Refunds How to cancel an install - and what you'll be refunded We understand that circumstances change. To provide fair notice and allow us to reschedule other work, cancellations must be made at least 72 hours before the scheduled install time. Refund Policy 72-hour rule: Cancel 72 hours or more before your install = full refund (except the 811 filing fee, see below). If 811 was already filed: The $20 (or $10 if discounted) 811 filing fee is non-refundable - we've already paid the utility locating service and cannot recover that cost. The post portion is refundable: If you cancel before install, we refund all labor and material costs related to the sign post installation. You only retain the 811 filing charge if it was already processed. Cancellations within 72 hours: If you cancel less than 72 hours before the scheduled install, no refund is issued. We hold a crew slot and incur costs to keep that time available. After 72 hours notice, we can reassign crew and offer refunds. Reschedule Install - We get it, listing dates change. Let us know as soon as you know so we can discuss next steps if needed. Charges only occur 24 hours before the scheduled install if rescheduled. A $20 reschedule fee will be applied. 811 clearance lasts for 30 days so if we have to push the listing past that window another 811 ticket needs to be filed thus another 811 fee (discounted or not depending on if flags are placed already and still intact). We'll acknowledge the cancellation and process any applicable refund within 5 business days. Important: Verbal cancellations may not be recorded. Please cancel in writing (text, email, or through the portal) to ensure we process your request correctly and have a record of the cancellation time. 6. Payment Terms & Late Fees When payment is due - and consequences of late payment Payment is due within 7 days of installation, or as otherwise outlined in your invoice. We offer flexible payment arrangements, but timely payment helps us maintain the quality and speed of our service. Payment Methods We accept payment through: Our online portal (credit/debit card, processed securely via FluidPay) Direct bank transfer / ACH Check (made payable to North Shore Sign Co) Cash (for on-site completion) Late Payment Fees If an invoice remains unpaid 15 days after the due date, the following charges apply: A 1.5% monthly service charge on the outstanding balance (18% per year) A one-time $35 late payment processing fee per invoice Example: A $500 invoice unpaid after 15 days incurs a $35 processing fee + $7.50 (1.5%) monthly service charge = $542.50. The 1.5% monthly charge continues to accrue on the unpaid balance until paid in full. Failed Payments If a credit card payment or ACH transfer fails: We will attempt one automatic retry within 3 business days. If the second attempt fails, a $35 failed payment fee is added to the invoice. You must provide updated payment information or arrange alternative payment promptly. Repeated payment failures may result in suspension of future services and referral to collections. 7. To manage risk for both parties, we maintain professional liability insurance and set clear boundaries on our responsibility. What We're Liable For North Shore Sign Co is responsible for: Injury or damage caused by our negligence during installation, removal, or maintenance Damage to the property or landscaping caused directly by our crew's actions (e.g., hitting a utility line despite proper 811 clearance, damaging a fence during install) Defects in our workmanship - if a post is installed incorrectly and fails, we're responsible for repair or replacement Loss or theft of sign components caused by our failure to secure the installation properly What We're NOT Liable For North Shore Sign Co is NOT responsible for: Theft, vandalism, or intentional damage to the sign after installation (unless theft occurs due to our failure to secure it) Injury or property damage caused by the seller, agent, third parties, or natural causes (weather, ice, fallen branches) Utility line damage when the 811 marking was in place and we followed all safety protocols Sign design defects, durability issues, or material failure - the agent/seller provides the sign materials Lost business or lost commission revenue due to service delays, cancellations, or other circumstances Indirect, incidental, or consequential damages of any kind Weather-related damage to the sign after installation (wind, rain, hail, snow) - this is the responsibility of the property owner and their insurance Liability Cap North Shore Sign Co's total liability for any claim related to a single service is capped at the total amount paid for that service. If you paid $150 for an install and removal, our maximum liability is $150 - regardless of the nature of the claim. For services involving multiple components (install + LEDs + removal), liability is capped at the total contract value. Insurance: North Shore Sign Co carries professional liability insurance. All claims should be submitted in writing with documentation (photos, receipts, repair estimates) within 10 days of the incident. 8. Property Damage Disclaimer What's not our responsibility when installing a sign on your property The installation process involves digging a hole and placing a post in the ground. While we take care to minimize impact, property owners need to be aware of potential contact with landscaping, irrigation systems, and existing features. What We Don't Cover We are not responsible for: Pre-existing lawn or landscape issues - rocks, clay soil, poor drainage, slopes, dead grass Minor turf disturbance from the installation process - a small divot or temporary discoloration is normal Hidden sprinkler systems, drain lines, or private utilities that aren't marked by 811 Damage to flower beds, shrubs, or other landscaping near the installation area Post-installation lawn settling around the hole - this is normal and typically heals within a few weeks Our Responsibility During Install We will take care to: Review all 811 markings before digging Dig carefully to avoid contact with utilities or landscaping Pack soil neatly around the post Leave the area tidy after completion Pro tip for sellers: If you have known underground features (sprinkler lines, septic systems, pools), let us know when booking. Weather & Acts of God How we handle installs delayed or affected by weather or unforeseen circumstances We work in the Pacific Northwest, where weather is unpredictable. Occasionally, conditions may delay or prevent installation on the scheduled date. Weather Delays If severe weather makes it unsafe or impossible to work, we will: Cancel or postpone the install Notify you as soon as possible (typically the morning of or the day before) Reschedule at the next available date that works for you and our crew Make no charges for the delayed date We do not offer refunds for weather delays. Instead, we reschedule at no additional cost. If you need to cancel entirely due to weather (e.g., listing expires before we can reschedule), a cancellation fee may apply per our Cancellation Policy. Unsafe Conditions We reserve the right to postpone installation if: Heavy rain or flooding makes the ground too soft or saturated to safely dig High winds pose a safety risk to our crew or equipment Extreme heat creates unsafe working conditions Snow, ice, or frost makes the ground inaccessible or the site unsafe Utility crews are still working on the property or blocking access No refunds for weather. We do not refund or reduce charges due to weather delays. The service is simply rescheduled for the next available date. Acts of God & Unforeseen Circumstances We are not responsible for delays caused by circumstances beyond our control, including: Natural disasters (earthquakes, floods, wildfires) Utility emergencies (power outages, gas leaks) Street closures or emergency vehicle access Pandemics or government-mandated lockdowns Unexpected road conditions or accidents affecting crew access 10. Access & Site Conditions What we need from you to complete the install Before we schedule an install, the agent/seller must ensure the property is accessible and the conditions are suitable for safe installation. Legal Access & Permission The agent/seller warrants that: They have full authority to grant permission for sign installation on the property The property owner has consented to the sign placement No HOA, easement, or local ordinance restrictions prevent sign installation (see Sign Compliance policy) Our crew will have safe, legal access to the installation area without trespassing Agent responsibility: If the seller later claims they never authorized the sign, or an HOA sends a cease-and-desist order, the agent is liable for all costs and consequences - not North Shore Sign Co. Site Condition Requirements For safe installation, the site must have: Accessible ground - not waterlogged, frozen, or covered in snow Adequate space - enough room to dig and set the post without interference No heavy debris or obstacles blocking the placement area Clear view of 811 markings if they've been placed If Conditions Are Unsuitable If we arrive and the site is unsafe or inaccessible: We will not proceed with installation A full service charge still applies - we held a crew slot for your date We will reschedule when conditions improve, at no additional charge Schedule flexibility: If you know the site will have access issues on your booked date, let us know in advance so we can reschedule without charging a service fee. 11. Change Orders & Extra Work How to request changes and what additional work costs Sometimes things change after booking. We're happy to accommodate modifications, but any work beyond the original booking scope requires a separate agreement and payment. Sign Compliance & Zoning Agent responsibility for zoning and HOA compliance Real estate signs are subject to local zoning ordinances, HOA restrictions, and city regulations. North Shore Sign Co installs signs as requested by the agent, but the agent is responsible for ensuring compliance with all local laws. Agent Responsibility Before booking, the agent must verify that a real estate sign is permitted: In the property's zoning classification (residential, commercial, mixed-use, etc.) In compliance with local sign size and placement ordinances Not prohibited by the property's HOA or CC&Rs Not placed in a city right-of-way or public easement In compliance with any local sign permit requirements What If Compliance Issues Arise? If an HOA, city, or property owner issues a cease-and-desist order or citation: The agent is liable for compliance verification North Shore Sign Co will remove the sign at no charge upon request No refund is issued for the installation fee - the agent bears the cost of non-compliance Any fines or penalties imposed by the city or HOA are the agent's responsibility Important: We install signs - we don't verify zoning compliance. Agents must do their own due diligence before booking. Ignorance of local regulations is not an excuse and does not release an agent from responsibility. For questions about zoning or HOA rules: We recommend agents contact the local city or HOA directly before booking. This protects the agent, the seller, and us. 13. Design & Materials We install what you provide - durability and content are your concern North Shore Sign Co installs the sign panels and other components provided by the agent or seller. We do not design signs, select materials, or warrant the durability or quality of materials supplied. Material Durability & Failure We are not responsible for: Color fading or weathering of the sign panel Delamination, warping, or material breakdown Ink or print quality issues Rust or corrosion of metal components Cracking or breakage of plastic or composite materials These are normal effects of weather and time. The material supplier and agent are responsible for selecting appropriate sign materials for outdoor use. Sign Content & Messaging The agent/seller provides all sign content and messaging. We install it as-is and are not responsible for: Accuracy or legality of information on the sign Compliance with fair housing laws or advertising standards Accuracy of property details, pricing, or features Offensive or inappropriate messaging Legal responsibility: The agent and seller are solely responsible for ensuring sign content complies with all fair housing laws and advertising regulations. Installation Quality What we are responsible for: Secure, level installation of the post Proper attachment of sign components to the post Functioning LEDs and electrical connections (if installed) Photo documentation of the completed install 14. Indemnification Who is responsible if a third party sues because of the sign By booking a service with North Shore Sign Co, the agent and seller agree to defend and protect us from liability arising from their actions, the sign content, or property-related issues. What You Indemnify Us For The agent/seller agrees to indemnify and defend North Shore Sign Co against all claims, damages, and legal costs arising from: Sign content or messaging - including false advertising, fair housing violations, or defamatory statements Property damage caused by the agent or seller (e.g., they install the sign incorrectly) Injury claims stemming from the seller's property conditions, not our installation Zoning or HOA violations (agent's responsibility to verify compliance) Failure to disclose material facts about the property Breach of the agent's legal duties to the buyer or seller Any legal action brought by the property owner claiming unauthorized sign installation In plain English: If a buyer sues because the sign had false information, or the HOA fines the seller for an unauthorized sign, or someone is injured due to the seller's property condition - you (the agent) pay for those claims, not us. We install signs; we don't create liability for content, zoning, or property issues. Insurance: We carry professional liability insurance for our installation services. However, our insurance does not cover claims related to sign content, zoning violations, or agent/seller actions. You should maintain appropriate business liability insurance to cover your responsibilities as a licensed agent. 15. Insurance & Risk Management Protecting your interests with proper insurance coverage Real estate signs represent a valuable asset, but they also carry some risk. We recommend that agents and sellers take proper steps to protect themselves. Our Insurance North Shore Sign Co carries professional liability insurance that covers: Injury or damage caused by our negligence Defects in our workmanship (poor installation, failed posts) Errors in our 811 filing or utility coordination Our insurance does NOT cover: sign content, zoning violations, theft after installation, or claims arising from agent/seller actions. Your Insurance (Agent / Seller) Agents: Ensure your E&O (Errors & Omissions) insurance covers sign installation and liability related to the sign content and placement. Verify with your broker. Sellers: Your homeowner's insurance may cover theft or damage to the sign. Consider adding the sign to your homeowner's policy or filing a rider. This protects you if the sign is stolen or damaged by weather. Tip: When booking a sign, ask the seller if they want to add it to their homeowner's insurance. This provides them with replacement coverage if theft occurs. We also use selected photos to showcase our work and build our portfolio. Our Photo Use Rights By booking a service, you grant North Shore Sign Co the right to: Photograph the installed sign at no charge Use photos for our internal records and documentation Use photos on our website, social media, and marketing materials Display photos in our portfolio or case studies Share photos with industry partners or suppliers for quality assurance Privacy Considerations When we share photos: We do not include the property address in captions or metadata. Metadata is stripped prior to posting. Agent Authority & Seller Consent Agent's warranty of authorization to book services When an agent books a service with North Shore Sign Co, they represent that they have full authority to contract on behalf of the seller and that the seller has consented to sign installation. Agent's Warranty By submitting a booking, the agent warrants: They are a licensed real estate professional authorized to act on behalf of the seller The seller has provided written consent to the sign installation The agent has authority to sign binding agreements for the seller All information provided in the booking is accurate The property address and owner information are correct If the Seller Disputes the Sign If the seller later claims they did not authorize the sign: The agent remains financially liable for the full cost of installation We will remove the sign at no additional charge upon request The agent cannot dispute or refuse payment based on the seller's later objections This is an agent-seller dispute - North Shore Sign Co is not involved Critical: Always obtain written consent from the seller before booking a sign. If a dispute arises about authorization, you (the agent) are financially responsible. We will not adjudicate agent-seller disputes. Payment Responsibility Even if the seller refuses to pay, the agent is liable for the full service cost. If the agent disputes the charge claiming the seller didn't authorize it, we will: Request the written consent documentation from the agent If no written consent exists, the agent's warranty is questioned Forward the unpaid invoice to collections Pursue legal action if necessary 18. Right to Modify Service We reserve the right to modify service delivery for safety or efficiency While we aim to deliver service exactly as requested, safety, site conditions, and operational realities sometimes require us to make modifications. We reserve the right to do so without additional charge. How We Define the Coverage Boundary Our service boundary runs roughly from La Conner in the north to Port Orchard in the south, with the eastern edge following the I-405 corridor. The western boundary follows the Puget Sound shoreline. For extended and outer-area listings, availability depends on scheduling and routing for that week. These areas are served on a case-by-case basis - we do our best to accommodate them, particularly for agents with multiple listings in the area. Travel & Out-of-Area Fees Installs within our core service area are covered at standard pricing. For extended-coverage locations, a travel fee may apply depending on distance from our base in North Seattle. We'll always confirm any additional charges before scheduling - no surprises.
